Terms of Service

1.Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Oxign platform, websites, and related services (collectively, the "Service") operated by Oxign ("Oxign", "we", "us", or "our"). By accessing, browsing, or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2.Description of service

Oxign is a carbon-management demonstration platform that helps small and medium-sized businesses estimate, organise, and present their greenhouse-gas emissions across Scope 1, Scope 2, and Scope 3 categories. The Service may include carbon footprint calculators, reporting dashboards, verification records, and an associated marketplace. The Service is provided as a demonstration and may change, be suspended, or be discontinued at any time without notice.

3.Accounts & eligibility

To access certain features you may need to create an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must be at least 18 years of age, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Service. You agree to notify us promptly of any unauthorised use of your account.

4.Subscriptions & billing

Oxign offers a free 7-day Survey trial and three paid plans — Verified ($99/month), Neutral ($199/month), and Net Zero ($499/month) — each also available at a discounted annual rate, with payments processed through Stripe. Unless cancelled beforehand, a Survey trial converts automatically to the Verified plan when the trial period ends. In this demonstration deployment, billing is provided for testing purposes only: no real payment is taken, no live charges are made, and no real payment credentials are required. Where a subscription would apply, fees would be billed in advance on a recurring monthly or annual basis until cancelled, and would be non-refundable except where required by law. You may cancel at any time, with cancellation taking effect at the end of the current billing period.

5.Acceptable use

You agree not to misuse the Service. In particular, you agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose;
• Submit data you do not have the right to submit, or that is false or misleading;
• Attempt to gain unauthorised access to the Service, other accounts, or related systems;
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure;
• Reverse engineer, scrape, or copy the Service except as permitted by law;
• Misrepresent demonstration or estimated outputs as audited or certified results.

6.Intellectual property

The Service, including its software, design, text, graphics, logos, and the "Oxign" name and marks, is owned by Oxign or its licensors and is protected by intellectual property laws. You retain ownership of the data and content you submit to the Service. By submitting content, you grant Oxign a limited, non-exclusive licence to host, process, and display that content solely to provide and operate the Service. No rights are granted to you except as expressly set out in these Terms.

7.Carbon data accuracy

Carbon footprint figures produced by the Service are estimates generated from the activity data you provide together with published emission factors. They are not audited, certified, or independently assured, and in this demonstration deployment may be illustrative or sample values. Estimates should not be relied upon for regulatory filings, statutory disclosures, financial decisions, or public claims without independent verification by a qualified professional. Actual emissions may differ materially from any estimate shown.

8.Disclaimers & limitation of liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Oxign does not warrant that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Oxign and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Service. Because this is a non-commercial demonstration, no fees are genuinely collected and no liability is assumed.

9.Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

10.Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Oxign is established, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction. As this is a demonstration deployment, these Terms are not intended to create legally enforceable obligations.
